I will preface this blog once again by saying...

This isnt a rep vs dem or pro vs anti vax blog..

This is about our rites.

So in and out burger in san fran got shut down because they were asking for " papers"..
Before serving customers.

Cali put in some wackado mandiate that you must show your vax status or else you cant come inside..

Like i said this isnt a pro or anti vax blog.

But the city of san fran closed in and out for a day because they refused.

But i agree with in and out burger saying they are not the police when it comes to patrons.

It's not the 14 dollar an hour cashiers job to confront angry patrons and enforce...

A mandate???

I think it's akin to asking the restraunt/ store to enforce other city laws like no smoking,public intoxication,public exposure etc.
The store usually doesnt confront the customer and call the cops.

Or not...lots of bottom bisquit women ( women who wear shorts so short that their ass is literally hanging out) shop at say walmart.

But the city then doesnt roll by and fine/ shut the business down for non enforcement of a city law.

In and out isnt the police..nor nazis....they sell burgers..
Why the city isnt targeting non vaxed patrons instead of using small businesses as it's enforcement tool is beyound me..

Once again what is the role of a business...

Is it to police customers...is it their job to enforce laws?

What if...a state then demanded a business ask for proof of citizenship before a customer was allowed to enter and shop..

Ahhhhhh gotta luv that slippery slope ..

And by targeting the in and out iconic brand..isnt san fran trying a shakedown to keep mom and pops in line.

Im happy in and out stood up for our rites

Do you ever wonder what happened to their rights and the rights of the next lot of people who die from this? Or is killing off something like Kansas City no great loss?

You could widen your campaign, since this sort of law isn't all that new.

How about the poor old bar owners who have to stop serving just because their customers are exercising their rights to be drunk, perhaps in charge of a car. We must spend a lot of time complaining about dram shop laws. After all not all
drunk drivers kill or cause serious injury..

Or what about poor doctors forced to report child abuse under mandatory reporting laws. After all the abusers are just exercising their right to bring up children they way they want to without government overreach. Why should people be forced to help the state enforce that? After all not all children have the same experience of child abuse.

Hell and you don't have to attack San Francisco for those two laws- your own state has them.

Yet with any licenses...whether that be medical, education or hell my cdl..the government imposes requirements..which also includes the sale of food and alcohol.

But we aren't talking about licenses...

We are talking about emergency power mandates via a governor. To which can be implemented legally under the constitution
But this person can not gain new powers.

There is no law stating a business is to refuse patrons based on a medical decision.
There is no law that one must be vaccinated to shop..

Ergo where does the public official get the power to enforce such a requirement

It is a clear over reach of any previous power or previous law

People die in droves everyday...should we do away with cars or fast food. Should you need to prove your cholesterol level before we let you into a mcdonalds.

Isn't obesity also a national health hazard that directly affects the country and our economy.

I for one am not in favor of governmental over reach..like doj garland threatening to use federal fbi officers to investigate local school board meetings.
It is a clear abuse of federal powers

To which the head of the doj..garland..walked that one back.

Much like Biden walked back giving the irs the power to spy on bank accounts

Of course I'm on your side with all this stuff, but I heard some people come up with other things

They said you are talking about licences after all: "All restaurants, retail markets, bars, bakeries, catering facilities, commissaries, and cafeterias in San Francisco must obtain a permit to operate from the San Francisco Department of Public Health (SFDPH).". If they don't meet the conditions of the licence, then the law can make them stop selling it? That's a shocking piece of abuse of power.

But, some seemed to feel that your claims of overreach by the governor have overreached. The decision about the licence was taken by the county not the governor, after all.

Others may be worried that you'll carry on with this to heavily criticize Florida's governor next for overreach in interfering with schoolboards. A clear abuse of gubernatorial power should never be suggested there?

As for me, I couldn't agree more that people die in droves each day. It struck me that in fact everybody dies at some time or the other! So there's no point in having any rules in our truly free society that stop death from happening. Maybe some inconsiderate, stupid or mad people will do things to make others die earlier, but it's not a problem, they were all on the way out eventually.

A few thought that people who kill and maim other people in cars should be prevented from driving! If we saw a drunk driving dangerously along the road should we report him/her? Of course not, they are enjoying life and if they dispose of a few stupid people who couldn't stay out of the way that's not our problem. They're driving to add to the droves.

Some might ask, what was the first of those unalienable rights mentioned in the declaration of independence? oh yeah it was life wasn't it? People dying unnecessarily in droves might use their last gasp to say "but what about my right to life, why the fuck wasn't someone protecting that"?

Of course I agree with you on all this stuff, but some other people are dumb enough to be concerned. Thank God Trump is still president.

Ergo, as they say, aedificare in tuo proprio solo non licet quod alteri noceat

First off a license isnt a rite.. it always comes with conditions and standards.

Like i have a cdl...so my legal alcohol limit is half that of normal driver .04 instead of the normal bac of.08
Is it fair? Is it legal?..
But it's a conditions of having a license..

This is why the " you cant sell alcohol to a minor" arguement doesnt hold up..
It is a requirement to get/ keep a license to sell alcohol.

Im talking more so of any other public standards.
A city would never fine a business for letting...
A half naked woman or a publically intoxicate man into their store.

My arguement is the store isnt there to enforce the mandate. It's not the police.

Plus i argued that special emergency powers dont give politicans blank unlimited powers.
They cant exceed their current power or overstep existing law.

So i dont believe the gov of florida is legally overstepping anything...he is over ridding emergency law put in by cities,local gov and health deps.

To which i believe he has the states' rite to do so.

I see where you're coming from and have to agree. So to obey the county's law, the burger store owners should have called the police? Possibly that would have been a wise move for them to avoid the county taking away their licence because they hadn't met the county's conditions for the licence.

Things depends on circumstances hey? So in Missouri, if that store you mentioned had allowed half naked or drunk people in for lewd behaviour or sexual conduct so that it got financial benefit, then Missouri state's anti trafficking law might apply. The store owners could be committing a felony. So either the store obeys the law and doesn't let the people in (enforces it and calls the police) or risks getting thrown in jail.

Whichever way we look the damn government is trying to stop people from exercising their right to unreasonable behaviour that destroys the rights of others.
